Terms of Use
By using WhatsOpsHub you agree to the terms below.
1. Overview
a. WhatsOpsHub is a cloud-based operational platform (the “Service”) that lets organizations centralize, analyze and manage alerts, incidents and critical messages (for example from WhatsApp groups) into a unified real-time “War Room” dashboard. Through the Service you may access features, tools and content provided by WhatsOpsHub (“Provided Content”) and/or upload or submit your own data, messages and files (“User Content”). By combining Provided Content, User Content and the tools within WhatsOpsHub you can generate structured incident cards, dashboards, metrics and reports to support incident management and response.
b. The Service is available via WhatsOpsHub’s web, desktop or mobile interfaces (as provided by WhatsOpsHub). Use of the Service is governed by these Terms of Use (“Terms”), as well as any additional policies published by WhatsOpsHub (such as Privacy Policy or Acceptable Use Policy). By accessing or using the Service, you agree to be bound by these Terms.
c. If you register using an email address associated with a company, employer or other organization (“Admin Entity”), you represent and warrant that you have authority to bind that Admin Entity to these Terms. In such case, “you” and “your” refer both to you personally and the Admin Entity (the organization). The account created with such an email becomes a “Managed Account.” WhatsOpsHub may — at the Admin Entity’s request — reveal to the Admin Entity your name, email and account information, and may transfer control of the Managed Account to the Admin Entity, including rights to access, manage or delete content, change settings or control permissions.
d. For teams, businesses or organizations using WhatsOpsHub: if you create or manage a team on behalf of an organization, you confirm you have required authorization. By doing so you bind that organization to these Terms. If you are not authorized, then an authorized member must create the account or team.
2. Account, License and Scope of Use
a. Subject to your compliance with these Terms, WhatsOpsHub grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business operations.
b. You agree that each user account is personal and may not be shared, transferred or used by more than one individual (unless otherwise authorized under a business or team subscription). You are solely responsible for all activities performed under your account, including any data, User Content or actions executed.
c. You undertake to keep your login credentials (password, tokens, etc.) confidential, and promptly notify WhatsOpsHub in case of unauthorized access or suspicion of compromise.
3. Acceptable Use & Prohibited Conduct
You agree not to (and not to allow any third party to) use the Service or the User Content in ways that:
- Violate any applicable law, regulation or third-party right (including data protection laws, privacy, intellectual property, etc.).
- Transmit or upload malicious code, malware, viruses, spam, phishing attempts, or otherwise conduct unauthorized data scraping, mining, harvesting or automated extraction of data not belonging to you.
- Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code or underlying structure of WhatsOpsHub, or create derivative works based on the Service itself.
- Use the Service to build or operate a competing product or service.
- Bypass or attempt to bypass any usage restrictions, licensing controls, geo-restrictions or security protections implemented by WhatsOpsHub.
- Engage in behavior that is harassing, discriminatory, hateful, violent, or otherwise harmful to individuals or groups.
- Use the Service in any way that may damage, disable, overburden or impair the proper functioning of the Service, or interfere with other users’ use of the Service.
WhatsOpsHub reserves the right — at its sole discretion — to suspend or terminate your access and/or remove content if it determines, in good faith, that you have violated these rules.
4. User Content & Provided Content
a. User Content refers to any data, messages, files or information you upload, submit or store via the Service. You retain all ownership rights in your User Content. By uploading or submitting User Content, you grant WhatsOpsHub a worldwide, non-exclusive, royalty-free, sublicensable license to store, copy, display, transmit, and process your User Content as reasonably necessary to provide the Service (e.g. indexing, notification, analytics, dashboard display).
b. Provided Content includes any templates, icons, media assets, UI components, documentation or other materials offered by WhatsOpsHub as part of the Service. Any use of Provided Content is subject to additional license terms defined by WhatsOpsHub, and you agree to comply with those license restrictions.
c. You represent that you have all necessary rights, consents and permissions for any User Content you upload, and that such content does not infringe any copyright, trademark, privacy or other rights of third parties. WhatsOpsHub may remove or block access to any User Content that allegedly violates third-party rights or these Terms.
5. Data Security & Privacy
WhatsOpsHub will implement reasonable technical and organizational measures designed to protect your data against unauthorized access, alteration, disclosure or loss. However, no method of transmission or storage is completely secure, and WhatsOpsHub cannot guarantee absolute security.
Use of the Service also requires compliance with WhatsOpsHub’s Privacy Policy, which governs how personal and organizational data is collected, handled, processed, stored and, if necessary, deleted. You agree to review the Privacy Policy before using the Service.
6. Disclaimer of Warranties & Limitation of Liability
a. The Service is provided “as-is” and “as-available”, without warranties of any kind, whether express, implied or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation.
b. WhatsOpsHub does not guarantee that the Service will be error-free, available at all times, secure from breaches, or that data will never be lost or corrupted. You acknowledge that you use the Service at your own risk.
c. In no event will WhatsOpsHub, its officers, employees, contractors or licensors, be liable for any indirect, incidental, special, punitive or consequential damages arising out of or relating to your use of (or inability to use) the Service — even if WhatsOpsHub has been advised of the possibility of such damages.
7. Termination
a. You may terminate your account at any time, for any reason, by contacting WhatsOpsHub or through the account settings (if available). Upon termination you must cease all use of the Service.
b. WhatsOpsHub may suspend or terminate (in whole or in part) your access to the Service at any time, if you violate these Terms or when it deems necessary (for example, due to security, compliance or maintenance reasons).
c. After termination, WhatsOpsHub may delete or permanently archive your User Content. Unless required by law, WhatsOpsHub will not be liable for any loss or damage arising from termination or suspension of the Service.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [insert governing jurisdiction — e.g. the State of Delaware, USA, or the country where your company is established], without regard to conflict of law provisions.
Any dispute, claim or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration under [insert arbitration rules/institution], unless otherwise required by applicable law.
9. Changes to Terms and Service
WhatsOpsHub may update, modify, add or remove portions of these Terms at any time. When material changes are made, WhatsOpsHub will notify you (for example via email or in-app notification). Continued use of the Service after such changes constitutes acceptance of the new Terms.
WhatsOpsHub also reserves the right to change, suspend or discontinue features or functionalities of the Service (in whole or in part), at any time, with or without notice.
10. Miscellaneous
a. These Terms constitute the entire agreement between you and WhatsOpsHub regarding your use of the Service, superseding all prior or contemporaneous agreements, understandings or communications, whether written or oral.
b. If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full effect.
c. You may not assign or transfer your rights or obligations under these Terms without prior written consent of WhatsOpsHub.
d. Notices and communications between you and WhatsOpsHub may be made via email, in-app notifications or other contact details you provide. It is your responsibility to keep such contact information up-to-date.
e. Failure by WhatsOpsHub to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
f. WhatsOpsHub shall not be liable for delays or failures in performance caused by events beyond its reasonable control (force majeure), including but not limited to natural disasters, network or infrastructure failures, acts of government, or other unforeseeable circumstances.
